SIJ Filing on the Twenty-First Birthday: Why Borges Borsoi Was Too Late

For Special Immigrant Juvenile classification, the federal filing deadline can be decisive even after a state court has entered the necessary findings. This AAO precedent holds that a petitioner subject to the under-21 requirement must file before the calendar date of the twenty-first birthday. An argument based on the exact hour of birth did not save a petition received that morning.

The decision was originally entered on March 5, 2025 and revised for designation as precedent on September 23, 2026. It concerns federal SIJ classification, not a general ruling about age calculation under every immigration statute.

A qualifying court judgment did not complete the federal filing

The petitioner was born in Brazil on March 8, 2002. She sought a Massachusetts court order on March 1, 2023 and obtained a March 3 judgment containing dependency, parental neglect or abandonment, and best-interest findings. Three petition packages were mailed on March 6 and 7. USCIS received all three on March 8—her twenty-first birthday. The appeal concerned one of the denials. See pages 68–70.

She argued that receipt occurred before the afternoon hour at which she had been born, so she was still biologically twenty. The AAO rejected that fractional-day approach. For the regulation’s age requirement, the birthday’s calendar date controlled.

Why the date mattered more than the hour

The AAO interpreted the under-21 language in 8 C.F.R. § 204.11(b)(1) using ordinary age calculation. It also explained the practical problems of a birth-hour rule, including time zones and inconsistent documentation. The resulting uniform rule treats a person as twenty-one on the twenty-first birthday. See pages 70–76.

The AAO distinguished the Second Circuit’s Duarte-Ceri citizenship decision rather than treating it as controlling this SIJ petition arising in the First Circuit. It also addressed favorable district-court SIJ rulings without extending their effect beyond the parties. Footnote 8 expressly leaves other statutory contexts, including citizenship and statutes of repose, unresolved.

Receipt, age protection, and the limits of agency authority

For this filing, the controlling event was USCIS receipt, not the mailing date. Eligibility had to exist when the petition was properly filed. The statutory protection against later aging out protects someone who qualifies at filing; it does not retroactively make a birthday filing timely. See pages 77–79.

The AAO also declined to apply retroactively an in-person filing practice introduced after these petitions were submitted. The decision does not establish which emergency filing options are available today. Those procedures require separate verification before anyone relies on them.

What the decision means for case preparation

The AAO dismissed the appeal because the age requirement was unmet and it lacked authority to waive it. A state court’s jurisdiction and findings do not extend the federal filing deadline. The case was not an adjudication granting or denying every other possible immigration benefit.

Preparation should therefore account separately for obtaining the state-court order and completing a proper federal filing with time for delivery or correction. Counsel should verify the applicable age rule, current submission procedures, and proof of receipt. A court order signed before the birthday is an essential part of some cases, but it is not a substitute for timely federal receipt.
